Our Agreement With You

We are Live the Weekend Limited, a company registered in England and Wales with company number 06123832. Our registered address is 54 Paramount Court, University street, London. WC1 6JP . Our Agreement with you sets out what you are legally entitled to expect from us when you buy our travel services.

1. Our Travel Booking

1.1 Once you have made your booking we will send you an invoice or a confirmation receipt. If there is any change to any of the details discussed at the time of booking, before the invoice or confirmation receipt is issued, we will notify you promptly of any new or changed details, including a change to the total price (if any). Your rights in respect of any changes are set out in clause 2 below. If any detail on the invoice or confirmation receipt is not correct please tell us immediately.

1.2 Your contract will either be with us or with another supplier of travel services and this will depend on the type of arrangements you book: Your contract will be with us if we arrange at least two or more of the following services at an inclusive price when the services are taken together and also either cover a period of more than 24 hours or include overnight accommodation:-
(a) transport;
(b) accommodation; and
(c) other tourist services not ancillary to transport or accommodation which account for a significant part of the arrangements.

For all other arrangements, we are the booking agent for a number of suppliers. Your contract will be with the supplier and we accept no responsibility for their actions or omissions. If we are the supplier’s booking agent, the clauses set out below that refer to your booking as a “weekend” will not apply to you.

2. The Price You Pay

2.1 All prices we advertise are accurate at the date published. Subject to the rest of this clause 2, we reserve the right to increase the price of your weekend after you have booked. If we are your booking agent, then we, acting on behalf of your supplier, will pass on any price increase in accordance with the conditions of the contract with your supplier.

2.2 For all other arrangements, after an invoice or confirmation receipt has been sent to you, any increase to your weekend price will be as the result of changes in our costs of supplying your weekend resulting from transportation charges and government action.

2.3 If the increase would be 2% or less of the weekend price shown on your invoice or confirmation receipt (excluding any amendment charges), we will absorb the changes in our costs described above and will only pass on any increase above that level. If any change in our costs would cause a reduction in your weekend price, we will not make refunds of amounts less than 2% of your weekend price (calculated as above), but we will refund in full amounts exceeding such 2%.

2.4 If the increase is more than 10% of the weekend price (calculated as above), then:
(a) You may cancel your weekend booking within 14 days of our notification to you of the change date and receive a refund of all monies paid to us; and
(b) The increase will be considered a major change as described in clause 5 below and, unless you choose to cancel under clause 1 above, you will be entitled to the alternatives set out in clause 5 for those circumstances. Should you wish to cancel we will pay you compensation, using the scale shown (unless we cancel your weekend because of one of a Force Majeure event defined in clause 5 below).

3. If We Cancel Your Booking

3.1 If we are your booking agent, your contract with your suppliers may allow them to cancel bookings. We accept no liability for the changes or costs incurred which may result.

3.2 For all other arrangements we aim to provide your weekend as booked. However, we reserve the right to cancel your weekend in any circumstances but if we cancel your weekend you can either have a refund or accept a replacement weekend from us of equivalent or closely similar standard and price (if one is available) unless we cancel your weekend because of one of a Force Majeure event defined in clause 5 below.

4. If We Change Your Booking Details

4.1 If we are your booking agent, your contract with your suppliers may allow them to change your booking details. We accept no liability for the changes or costs incurred which may result.

4.2 We reserve the right to make changes to your weekend at any time. We will let you know about any important changes when you book.

5. Major Changes To Your Weekend

5.1 Occasionally, we have to make major changes to the weekend. If we tell you about any of these changes after we have confirmed your weekend booking, you may either:
(a) Accept the new arrangements offered by us; or
(b) Accept a replacement weekend from us of equivalent or closely similar standard and price, if one is available; or
(c) Cancel your weekend with us and receive a full refund of all monies paid
In all cases, except where the major change arises due to reasons of force majeure, we will pay compensation as detailed below:

Force majeure: This means that we will not pay you compensation if we have to cancel or change your weekend in any way because of unusual or unforeseeable circumstances beyond our control. These can include, for example, acts of god, fire, explosion, adverse weather conditions, flood, earthquake, terrorism, riot, civil commotion, war, hostilities, strikes, riots or civil disturbances or acts of government.

6. Our Responsibility For Your Weekend

6.1 Your weekend arrangements will be provided either directly by us or through independent suppliers contracted by us. Except where we are a booking agent we are responsible for making sure that the weekend you book with us is provided to a reasonable standard and as was advertised by us (accepted by you).

6.2 Our liability in respect of any quality claims you may have in respect of your weekend is limited to £100 per person or the cost of your weekend, whichever is lower.

7. Personal Injury

7.1 Except when we are acting as your booking agent, we accept responsibility for death, injury or illness caused by the negligent acts and/or omissions of our employees or agents whilst acting within the scope of, or in the course of their employment in the provision of your travel arrangements. We will accordingly pay to you such damages as might have been awarded in such circumstances under English Law.

7.2 We do not accept responsibility for unusual and unforeseen circumstances beyond our control and the consequences of which could not have been avoided even if all due care had been exercised or could not be foreseen or forestalled.

Your Agreement With Us

8. Your Contract

8.1 By asking us to confirm your booking, you are accepting that the terms of this Agreement (and the conditions of any contract made with your suppliers) applies to your booking and your travel arrangements. Your contract with us is subject to the laws and jurisdiction of England and Wales.

9. Insurance

9.1 We require you to purchase travel insurance. We can provide details of a suitable policy. You must purchase either this policy or a policy that offers at least comparable cover under all sections. We reserve the right to cancel your weekend at any time should such a policy not be taken out by you.

10. Personal Property

10.1 All your property is your own responsibility, unless loss or damage is proven to be due to our negligence. You may be able to make a make a claim if the loss suffered is covered under the terms of your insurance policy.

11. Incompatibility

11.1 We reserve the right to exclude or refuse any person at any time, prior to and during the weekend if, in our opinion, that person is incompatible with the general well-being of other customers. Any additional fee we incur, including transportation home, will be at your expense, and no refund of the weekend cost will be made.

12. If You Cancel Your Booking

12.1 If you want to cancel your booking or part of it, you must advise us in writing. The letter must be signed by the person who made the booking.

12.2 Please note that a 100% cancellation fee would apply should you cancel your booking with us and, as such, you will not be eligible to receive any refund.

12.3 You may be able to make a make a claim if the cancellation is covered under the terms of your insurance policy.

13. If You Have A Complaint

13.1 If we are the booking agent, your contract with your supplier may have a complaints procedure to follow.

13.2 Please write to us if you have a complaint prior to the commencement of your weekend.

13.3 If your contract is with us and you have a complaint about your arrangements whilst away, you must immediately notify the supplier of the service in question locally. If they are unable to resolve the problem you must write to us within 28 days of returning from your weekend. If you do not give us the opportunity to resolve any problem locally by reporting it to the supplier, then we may not be able to deal positively with any complaint on your return.

14. The Conditions Of Your Ticket

14.1 When you travel, your journey may be subject to certain international conventions such as the Warsaw Convention, Montreal Convention or Athens Convention. You agree that the transport company’s own ‘Conditions of Carriage’ will apply to you on that journey. When arranging this transportation for you, we rely on the terms and conditions contained within these international conventions and those ‘Conditions of Carriage'. You acknowledge that all of these terms and conditions form part of your contract with us as well as with the transport company.
